Terms of Use
These terms cover this website and the Android apps published by RejectedAlts Studios, including Flex Alarm Pro. They are written to be read, not skimmed. If you use the site or install an app, you agree to them.
1. Who you are dealing with
RejectedAlts Studios is the registered Ohio trade name of Victor R Okowita, a sole proprietor in Avon, Ohio, United States ("we", "us", "the studio"). Contact details are in section 11.
2. Using this website
The content of this site (text, logos, artwork, the Flex app names) belongs to the studio or its licensors. You may view it, link to it and download the press-kit files on the Press page for editorial use about the studio and its products. You may not copy the site, use our logos or product names to suggest an endorsement, or use the site in a way that interferes with it. Links to other sites are provided for convenience; we are not responsible for their content.
3. Using our apps
When you install one of our apps from Google Play, we grant you a personal, non-exclusive, non-transferable licence to install and use it on Android devices you own or control, for your own use. The Google Play Terms of Service also apply to the download and to any purchase. You may not copy, modify, sell, rent, reverse-engineer or redistribute the app, remove any notice from it, or use it to break the law. The app and everything in it remain the property of the studio and its licensors; the app includes open-source components; their licence notices are available on request from support@rejectedaltsstudios.com.
4. Free, Pro and the trial
- Free. Our apps are free to install and use. The free app has no ads and needs no account.
- Pro. Some apps offer a one-time "Pro" unlock that adds extra features. Flex Alarm Pro's Pro unlock is US $3.99. It is a one-time purchase, not a subscription, and there is nothing further to pay. Google Play shows the price in your local currency, including any applicable tax, before you confirm.
- The trial. In the Google Play version, the Pro features are available free for 14 days from when you tap "Start 14-day Pro trial" in the app. No payment details are collected for the trial. When the 14 days end, nothing is charged and the free app keeps working: any photo backgrounds you already set stay as they are, and adding a new photo background needs Pro. The trial record is stored on that device and is not backed up, so the trial can start again after a reinstall.
- Buying and restoring. Once Pro is on sale on Google Play, the purchase is made through Google Play using your Google account's payment method. Google Play processes the payment and issues the receipt. The unlock is tied to the Google account that bought it: sign in to Google Play with that account on any device, open the app, and Pro is restored at no charge.
- Changes to features and prices. We may add, change or retire features in updates, and we may change the price of Pro for new purchases. A Pro unlock you have already bought stays unlocked for the app it was bought for.
5. Refunds
- Within 48 hours of purchase: request a refund from Google Play (on play.google.com: your profile picture, "Payments & subscriptions", "Budget & order history", then "Report a problem" on the order; Google's steps are at Request a refund on Google Play). Google decides and processes those requests under its own refund policy.
- After 48 hours: email support@rejectedaltsstudios.com within 14 days of the purchase with your Google Play order number (it begins with "GPA.") and a sentence on why. We consider every request and will reply. Refunds we approve are issued back through Google Play to your original payment method; we cannot refund any other way.
- Your legal rights as a consumer in your country, including any statutory withdrawal or cancellation right for digital content, are not affected by this section.
6. Alarms are not a safety system
An alarm app depends on the phone it runs on. Battery optimisation, Do Not Disturb, a muted or powered-off device, a drained battery, a system update, or a setting changed by you or by the phone maker can stop an alarm from ringing or being heard. We build our apps to be reliable and the Support page explains the settings that matter, but no app can guarantee that an alarm will ring. Do not rely on an alarm app alone for anything where a missed or late alarm could cause injury, loss or harm, such as medication, medical care, travel connections or the supervision of others.
7. No warranty
The website and the apps are provided "as is" and "as available". To the fullest extent the law allows, we make no warranty of any kind, express or implied, including that the apps will be error-free, uninterrupted, or fit for a particular purpose, or that an alarm, timer or notification will go off at the intended time. Some jurisdictions do not allow the exclusion of implied warranties, so some of this may not apply to you.
8. Limitation of liability
To the fullest extent the law allows, the studio is not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, lost data, missed appointments or missed events, arising from your use of, or inability to use, the website or an app, even if we were told such damages were possible. Our total liability for any claim relating to an app is limited to the amount you paid for that app through Google Play in the 12 months before the claim (which is zero for the free app). Nothing in these terms limits liability that cannot be limited by law, including for death or personal injury caused by negligence, or your statutory consumer rights.
9. Changes and ending these terms
We may update these terms. The current version is always at this address with the effective date at the top; a material change will also be noted in the affected app's release notes on Google Play. Continuing to use the site or an app after a change means you accept the new terms. You can end these terms at any time by uninstalling the app and no longer using the site. We may end your licence if you break these terms. Sections 6 to 10 survive termination.
10. Governing law
These terms are governed by the laws of the State of Ohio and the United States, without regard to conflict-of-law rules, and any dispute will be brought in the state or federal courts located in Ohio, unless the consumer-protection law of the country where you live gives you the right to a different law or court, in which case that right is not affected. If any part of these terms is found unenforceable, the rest still applies. These terms, the Privacy Policy and the Google Play Terms of Service (for purchases) are the whole agreement between you and the studio about the site and the apps.
